Nuisance Neighbours Receive Exclusion Order

Cheshire Peaks & Plains Housing Trust has successfully obtained two injunctions for Anti Social Behaviour against the Trust's tenant, Miss Stephanie Moore and her partner Mr James Daltri. Both orders exclude Mr Daltri from Miss Moore's home and surrounding land on Belgrave Road, Macclesfield. Breach of the injunctions will result in the couple's arrests.

The case against Miss Moore and Mr Daltri was taken to Macclesfield County Court on Tuesday 23rd September at which the exclusion order was granted as well as an injunction to prevent the couple from causing any further disruption to the neighbourhood. A possession hearing is to take place on the 20th October 2008.

Several neighbours came forward to give statements in the case against the couple, whos behaviour included the use of hostile and foul language, aggressive and violent arguments taking place within and outside of their home and verbal abuse being hurled at neighbours. Their offensive and threatening behaviour often left neighbours very distressed and frightened.

Support and advice on the implications of their actions were regularly offered to the couple by the Trust's specialist staff. Numerous meetings were set-up with Miss Moore, the Trust and other agencies such as Social Services. The couple often did not attend these meetings or accept the support that was offered. Neither did they attend the court hearing held against them.

The Trust believes that the successful result of the case is due to the dedication of witnesses and the Trusts Enforcement Team Leader, Chris Mairs. To support the witnesses, Chris installed audio and video cameras outside of key properties on Belgrave Road for further protection. He also offered support through regular group meetings, progress updates and advice.

We feel very strongly that all our residents have the right to enjoy a peaceful and safe home and environment. We have tried on numerous occasions to offer support to Ms Moore and Mr Daltri but to no avail. The witnesses have been dealing with this level of ASB for over a year now. Our specialist staff have been really committed to resolving this matter supporting the witnesses throughout, and working hard to put an effective case together. I am delighted that the courts have recognised the problems, and that our hard work has paid off with this excellent result. Id like to thank the witnesses who were brave enough to step forward, thanks to their courage and dedication we have had a fantastic result and have made a real difference to their neighbourhood.
