ASB Injunction for threat man

Wirral’s Anti-Social Behaviour Team has obtained a two-year Anti-social behaviour injunction against a man who was abusive and threatening towards a security officer employed by landlord Wirral Partnership Homes.

Action was taken on behalf of Wirral Partnership Homes by Wirral Anti-Social Behaviour Team against Sean Lavery, of no fixed abode, following an incident on February 2, 2007.

Lavery, who was under the influence of alcohol, was visiting an acquaintance in Sandbourne, Moreton, when he tried to kick his way into the high-rise flats located on Stavordale Road.  Lavery was asked to leave by security officers after he walked to Thornridge, one of the other blocks of flats, resulting in a complaint about his behaviour.  He was abusive and the officer called the police.

Lavery became very abusive and aggressive; the officer just managing to move him from the building.  Lavery's bottle of Southern Comfort smashed on the floor as he stumbled, but he continued shouting abuse and kicking at the door until the police attended.

An application for an injunction was made without Lavery's knowledge and an interim injunction was granted against him on Thursday February 8, 2007, pending a further hearing.

This week (Monday February 12, 2007), the 21-year old was issued with a 2-year anti-social behaviour injunction at Birkenhead County Court.

Under the terms of the injunction, Lavery is banned from threatening to use or using violence against any person residing or engaging in a lawful activity within the locality of Thornridge.  He is also banned from engaging or threatening to engage in conduct capable of causing nuisance or annoyance to any person residing or engaging in a lawful activity in the locality of Thornridge. 

Lavery was also banned from approaching, harassing or threatening the named security officer and from entering areas surrounding the high-rise flats. 

Caroline Laing, Manager of Wirral's Anti-Social Behaviour Team said: "Lavery's behaviour was entirely unacceptable.”

Brian Simpson, Chief Executive of Wirral Partnership Homes, added: "We will continue to take a firm stance against anyone who is responsible for such appalling behaviour against our staff or tenants.”

The anti-social behaviour injunction remains in force until 4.00pm on February 12, 2009 and if breached, Lavery faces up to two years' imprisonment.
