New Fylde Housing has successfully obtained an Anti-Social Behaviour Injunction (ASBI) against nuisance tenant William Twomey, of Walter Avenue, St Annes.
The ASBI prevents Twomey from committing acts of violence or making any threat of violence to any person residing on or visiting the Kilnhouse Lane Estate and also protects the lay witnesses who gave evidence in the case.
Twomey defended the application, granted earlier this year, at a hearing on November 10 at Blackpool County Court. He was unsuccessful in this and the ASBI is now in place for two years with the power of arrest if there are any breaches.
In his summing up, the appeal Judge referred to three key elements of the Housing Associations’ prosecution: the evidence given by the local community beat manager; the detailed evidence given by one of the witnesses which was written shortly after one of the incidents; and the sound and visual evidence provided by one of the witnesses which was taken during one of the incidents.
Deputy Director of New Fylde Housing, Tammy Bradley, said: “New Fylde Housing is very committed to ensuring that our estates are a safe place in which to live. We will not tolerate such behaviour, as demonstrated in this case, and are happy with the outcome which will offer protection to all of our residents, and reassure them that we have a tough stance on anti-social behaviour.
“The success of this case was due to several factors,
including close co-operation with other agencies (in this case the
Police), good legal representation, determined witnesses and a
desire to pursue matters of this nature.”
