Wirral’s Anti-Social Behaviour Team, in partnership with landlord Wirral Partnership Homes, has secured two interim Anti-Social Behaviour Injunctions against a Wallasey couple following threats made towards a neighbour.
Legal action was originally taken against Gillian Trevor of Brighton Street following complaints of anti-social behaviour, including threatening and abusive behaviour, fighting, shouting and damage to property.
At Birkenhead County Court on October 16, 2006, a Demotion Order was issued against Trevor, 38, a tenant of Wirral Partnership Homes. This reduced Trevor's security of tenure removing a number of rights, such as the right-to-buy or exchanging her home with another tenant.
More importantly, it means that ending her tenancy is a more straightforward process and can be done with two months' notice.
Following further incidents, notice was served on Trevor and an application for possession was made to Birkenhead County Court for Trevor's eviction from the property.
On Sunday January 21 2007 it is alleged that Trevor and her partner Paul Jones, 35, made threats towards the neighbour and witness in the possession case. An immediate application was made for anti-social behaviour injunctions against the couple without their knowledge.
Interim anti-social behaviour injunctions were issued, which were served on the couple by officers from the Anti-Social Behaviour Team later that evening. A further hearing was listed for February 1.
At Birkenhead County Court last week (Thursday February 1 2007) Trevor and Jones did not attend the hearing but were legally represented. The court extended the interim anti-social behaviour injunctions against them.
Under the terms of the orders, they are banned from threatening to use or using violence against any person residing or engaging in a lawful activity within the locality of their home. They are also banned from engaging or threatening to engage in conduct that is capable of causing nuisance or annoyance to persons residing or engaging in a lawful activity within the locality of their home.
They were also ordered not to approach the named witness. The Injunctions not only cover their behaviour but also ban them from instructing or encouraging another person.
The Injunctions were served on Trevor and Jones today (February 5, 2007). They will remain in force until April 20, 2007 when the matter is listed for trial. Powers of arrest are attached to the injunctions and if either is breached, will be treated as a contempt of court; punishable by up to 2 years' imprisonment.
A hearing will take place on March 28 2007 at Birkenhead County Court in relation to the application for Trevor's eviction from the property.
